Official Rules

The Country VIP Concert Experience Contest NO PURCHASE NECESSARY. Contest open to legal residents of Canada who are the age of majority or older in their province/territory of residence prior to October 25, 2009. Void outside of Canada and where prohibited by law. Contest begins at 12:00:01 AM Central Time (“CT”), October 25, 2009 and ends at 11:59:59 PM CT, December 15, 2009, (“Promotional Period”). Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

Two Ways to Enter:
1. Guests who book and stay during the Promotional period and check into any Country Inns & Suites By Carlson in Canada will receive information directing them to visit www.countryvipconcert.ca and follow the online instructions to complete the online entry form (first name, last name, street address (no P.O. Boxes), city, province/territory, postal code, date of birth (mm/dd/yyyy), daytime and evening telephone numbers, email address and confirmation number). Online submissions must be received by 11:59:59 PM CT, December 15, 2009 to be eligible.

2. On a plain piece of 3” x 5” paper, hand print your first name, last name, street address (no P.O. Boxes), city, province/territory, postal code, date of birth (mm/dd/yyyy), daytime and evening telephone numbers and email address. (If you do not have a telephone, indicate “No Phone”. Failure to comply with this or any other Official Rule will result in disqualification). Mail your entry in a hand-addressed, business-size (#10) envelope with first-class postage affixed, to: The Country VIP Concert Experience Contest, Kanata South PO, 680 Eagleson Road, PO Box 45086, Kanata, ON, K2M 2G0. Entries must be postmarked by December 15, 2009 and received by December 21, 2009. Limit one (1) entry per stamped envelope. No mechanically reproduced entries permitted. Illegible or incomplete entries are void. Not responsible for lost, late, damaged, delayed, mutilated, postage due, misdirected entries or entries not received by the entry deadline.

Automated methods of entry, including entry via third party websites, are prohibited. Incomplete entries are void. Limit one (1) entry per confirmation number and one (1) entry per person per day, regardless of method of entry. Neither Sponsor, nor its respective affiliates or subsidiaries or their respective officers, directors, employees or agents are responsible for: (1) interrupted or unavailable network, server or other connections, miscommunications, failed telephone or computer hardware or software or telephone transmissions or technical failures, Internet Service Provider/network/website accessibility or availability, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic; including without limitation the incomplete, incorrect or inaccurate capture of entry information; or (2) any injury or damage to persons or property which may be caused directly or indirectly in whole or in part, from entrant’s participation in the Contest or receipt or misuse of any prize. Sponsor reserves the right, in its sole discretion, to disqualify any individual found tampering (or attempting to tamper) with the entry process, the website, or the Contest. Any attempt by an entrant to deliberately damage the website or undermine the legitimate operation of the Contest is in violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek remedies and damages from any such entrant to the fullest extent permitted by law, including criminal prosecution. In case of a dispute as to identity of an online entrant, entry will be declared made by the authorized account subscriber of the email address provided on the entry form, who must comply with these Official Rules. Sponsor reserves the right, at its sole discretion, subject to the approval of the Régie in Quebec, to cancel, suspend or modify the Contest if it becomes corrupted in any manner, including due to fraud or other occurrences beyond Sponsor's control, such that it cannot be conducted as originally planned and, in the event of cancellation, to select a winner by random drawing from all eligible entries received prior to cancellation. Entries not complying with all rules are subject to disqualification at Sponsor's sole discretion.

Random Drawing: A random drawing will be conducted on or about December 23, 2009 from among all eligible entries received, at approximately 2:00 PM (CT) in Minneapolis, Minnesota by an independent judging organization, whose decisions are final and binding in all matters relating to the Contest. By participating, entrants agree to abide by and be bound by these official rules and the judge’s decisions. Selected entrant will be notified by telephone/email/mail. Before being declared a winner, the selected entrant must first correctly answer without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question.

Prize/Approximate Retail Value (ARV): (1) Grand Prize: A Jann Arden Meet and Greet VIP concert package. Package includes: a 3-day/2-night trip for winner and one (1) guest to the Jann Arden concert on January 28, 2010 at Massey Hall in Toronto, CA, round trip economy airfare for winner and guest from a major airport near winner’s residence to Toronto, (2) two night’s hotel accommodations (one room, double occupancy) at the Country Inn & Suites By Carlson in Oakville, Ontario, two (2) VIP concert tickets to the Jann Arden concert, limousine transportation to/from concert and a private meet & greet with Jann Arden, subject to availability. Trip dates are January 28, 2010 through January 30, 2010. Approximate Retail Value: $1,937.00 CAD. (Actual retail value may vary depending on winner’s point of departure and fare fluctuations. Any difference between stated approximate retail value and actual value of prize will not be awarded.) Any other expenses related to prize, including without limitation, meals, gratuities, non-specified ground transportation, luggage fees and incidental hotel and personal expenses, are the sole responsibility of the winner. Potential Grand Prize winner and his/her guest must sign and return an Affidavit of Eligibility/Release of Liability form within seven (7) days of notification. Noncompliance within this time period may result in disqualification and an alternate winner may be selected, time permitting. Return of any prize/prize notification as undeliverable, or failure to correctly answer the skill-testing question, may result in disqualification and an alternate winner may be selected, time permitting. If guest of Grand Prize winner is a minor (as determined by his/her province/territory of residence), winner must be his/her parent/legal guardian and must complete required paperwork on behalf of such minor. Grand Prize winner and guest must possess required travel documents (e.g. valid photo I.D.) prior to departure and must travel on the same itinerary. No transfer of prize. No substitution of prize or cash redemption, except as provided herein. Sponsor reserves the right to substitute a prize of equal or greater value in its sole discretion. Odds of winning will depend upon the number of eligible entries received by the entry deadline.

Eligibility Restrictions: Employees, directors and officers of Carlson Hotels Worldwide Inc., Country Inns & Suites By Carlson Inc., Gage Marketing Group, LLC., and each of their respective parent companies, affiliates, subsidiaries, franchisees, or any of their agents, advertising, promotional and other agencies, and their immediate families (parents, siblings, children and their respective spouses) and persons living in the same household (whether related or not) are not eligible to enter the Contest or win a prize. By participating and/or accepting a prize, entrants/winner release and agree to defend, indemnify and hold harmless Sponsor, Gage Marketing Group, LLC., and each of their respective parent companies, subsidiaries, affiliates, franchisees and the directors, officers, employees and agencies of any of the above entities (“Released Parties”) from any liability whatsoever for any injuries, losses, costs, expenses, or damages of any kind (including without limitation, all direct, indirect, incidental, special, punitive, exemplary, or consequential claims, losses or damages, including lost revenues, profits or good will, all penalties, and all attorney’s fees, disbursements and costs of suit) resulting from acceptance, possession or use/misuse of any prize or participation in the Contest and any travel related thereto.

Except where prohibited by law, entrants/winner agrees that under no circumstances will any entrant/winner be permitted to obtain awards for, and entrants/winner waives all rights to claim, attorney’s fees, and indirect, punitive, incidental, special, exemplary, and consequential damages and any other damages (other than actual out-of-pocket expenses), and any and all rights to have damages multiplied or otherwise increased.

Except where prohibited by law, by accepting a prize, winner agrees that Sponsor and its affiliated companies may use the winner’s name, address (city, province/territory), photograph, videotape, likeness, and/or prize information for advertising, publicity and promotional purposes and to use statements made by or attributed to winner relating to Sponsor or to this Contest and grants to Sponsor any and all rights to said use without further notice and/or compensation except where prohibited by law.

Privacy: Information entrants provide to Sponsor may be used to communicate with entrants regarding this Contest as well as for other purposes as described in the Sponsor’s Privacy Policy available at www.countryvipconcert.ca.

Country Inns & Suites By Carlson, Inc. reserves the right, at its sole discretion and subject only to the permission of the Régie des alcools, des courses et des jeux (the “Régie”) in Quebec, to cancel/suspend/modify the online portion of the Contest if it becomes corrupted in any manner such that it cannot be conducted as contemplated by these official rules and, in such event, to select winner by random drawing from all eligible entries received prior to and/or after (if appropriate) the action taken by Country Inns & Suites By Carlson, Inc. By participating, entrant agrees to the official rules and judges’ decisions.

Disputes/Choice of Law: For residents of provinces/territories other than Quebec, the Contest and any claims relating thereto are governed by the laws of the Province of Ontario. By entering, entrants agree that: (i) any action arising out of this Contest must be brought in the provincial or federal courts located in Toronto, Ontario; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; (iii) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, "Special Damages"), and (iv) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased Quebec Residents Only: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
